Error code 331

You will see the following error message in H&R Block’s 2024 tax software if you and your spouse or common-law partner are filing your returns together and the total of the home buyers’ amount claimed on both returns is more than $5,000:

The amounts entered in your return and your spouse’s return that you want to claim for the home buyers’ amount are more than the total amount you can claim together (${1}). Please adjust the amounts entered in both returns so the total is less than ${1}. We recommend claiming the credit on the return of the spouse with the higher income. [error code: 331]

How do I fix this?

On the Special situations page, adjust the amount entered for the home buyers’ tax credit in your and your spouse’s returns so that the total credit claimed between both of you is not more than $5,000, which is the maximum amount you can claim. We recommend that the spouse with the higher income claim the home buyers’ tax credit.

Note: You can find the Special situations page on the Credits & deductions tab under Required.
